These draft notices, orders etc. have been produced by the London HHSRS working group as a suggested template. Whilst every attempt has been made to ensure they are legally correct and fit for purpose, as with all legal documents any Authority proposing to use them is strongly advised to run them past its own legal team before doing so. The London HHSRS working group can take no responsibility for any negative outcomes from service of these notices/orders.

1. I have just looked at the overcrowding notice Sec 139 and para 3 is somewhat confusing and makes no reference to Schedule 2 rooms not to be used for sleeping purposes.

2.Looking in the blue Practical Guide to the HA 2004, page 230 para 11.6, it says that documents have to be produced at a specific place and time and can be copied. It also says in the notes on the HHSRS notice 2 (b) that the time and place for production needs to be specified.

The notice on the HHSRS website says that the information must be forwarded with 14 days.

Whilst I appreciate it may be easier for someone who is some distance away to provide a copy, the Act doesn't seem to allow for this albeit that Section B may work and we may get copies through the post but if we don't I don't see that we would be successful in a prosecution if the notice wasn't worded correctly.

Please see the note on the right regarding possible errors in these notices; Added Oct 2007.
